Terms of Service
These Terms of Service ("Terms") govern your access to and use of the websites, applications, and services operated by Polymarket ("we", "us", "our"). By creating an account, connecting a wallet, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least eighteen (18) years old, or the age of legal majority in your jurisdiction if higher, to use the Services. You represent and warrant that you are not located in, resident in, or a national of any jurisdiction subject to comprehensive sanctions, and that you are not acting on behalf of any such person.
Access to certain features may be restricted depending on your jurisdiction. We may require proof of eligibility at any time and may suspend or terminate access where eligibility cannot be established.
2. Accounts and wallets
The Services are non-custodial. You retain sole control of the cryptographic keys associated with any wallet you connect. We do not hold, and cannot recover, your keys or any assets held in your wallet.
You are responsible for the security of your device, your credentials, and your keys. You agree to notify us promptly of any unauthorised use of your account. We are not liable for losses arising from your failure to maintain the security of your wallet or credentials.
Any person who obtains your recovery phrase or private key is able to access your assets. We will never request your recovery phrase or private key through the Services, by email, or through any support channel.
3. Trading and settlement
The Services permit the purchase and sale of shares in prediction markets. Prices are determined by supply and demand. We do not set, guarantee, or influence prices, and we make no representation regarding the likelihood of any outcome.
Executed trades are final, save where a market is resolved in accordance with its published resolution criteria. Where resolution criteria are ambiguous or a market is subject to dispute, resolution may be deferred pending review.
4. Fees
Fees are disclosed at the point of trade. Trading fees are deducted from proceeds. Network fees charged by the underlying blockchain are your responsibility and are not collected by us.
We may amend our fee schedule on notice. Continued use of the Services after a fee change takes effect constitutes acceptance of the revised schedule.
5. Prohibited conduct
You agree not to:
- Use the Services in violation of any applicable law or regulation;
- Manipulate, or attempt to manipulate, the price of any market;
- Trade on the basis of material non-public information;
- Use automated means to access the Services in a manner that places unreasonable load on our infrastructure;
- Interfere with, or attempt to gain unauthorised access to, the Services or any related system;
- Circumvent geographic or eligibility restrictions by any means.
6. Risk disclosure
Trading involves substantial risk. You may lose the entire amount you commit. Prediction markets are volatile, and liquidity may be insufficient to exit a position at the price you expect.
Blockchain transactions are irreversible. Transactions submitted to a blockchain cannot be cancelled or reversed by us. You are solely responsible for the accuracy of any address you enter.
7. Intellectual property
The Services, including all software, text, graphics, and marks, are owned by us or our licensors and are protected by applicable intellectual property law. You are granted a limited, non-exclusive, non-transferable licence to use the Services for their intended purpose.
You may not copy, modify, distribute, reverse engineer, or create derivative works from any part of the Services without our prior written consent.
8. Disclaimer of warranties
The Services are provided "as is" and "as available", without warranty of any kind, whether express, implied, or statutory, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that any defect will be corrected.
9. Limitation of liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or digital assets, arising out of or in connection with your use of the Services.
Our aggregate liability arising out of or relating to these Terms shall not exceed the greater of one hundred United States dollars (USD 100) or the total fees paid by you to us in the twelve months preceding the event giving rise to the claim.
10. Dispute resolution
Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration on an individual basis, and not as a class, collective, or representative action. You and we each waive any right to trial by jury.
Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction to protect its intellectual property or confidential information.
11. Changes to these Terms
We may amend these Terms from time to time. Material changes will be notified through the Services or by email at least fourteen (14) days before they take effect. Continued use after the effective date constitutes acceptance of the amended Terms.
